Arbitration Procedure

The arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, available at www.adr.org. The arbitrator's decision will be final and binding. Judgment on the arbitration award may be entered in any court of competent jurisdiction.

The arbitration will be conducted in the English language. Unless you and we agree otherwise, the arbitration will take place in the county where you reside or by telephone or video conference. Each party will bear its own costs except as provided in the AAA Consumer Arbitration Rules, which may require us to pay certain filing and arbitration fees.

Class Action Waiver

YOU AND A&H Enterprise Capital Investments LLC EACH AGREE THAT ANY DISPUTE WILL BE RESOLVED ONLY ON AN INDIVIDUAL BASIS AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding. If this class action waiver is found to be unenforceable, then the entirety of this Dispute Resolution and Arbitration section will be null and void, but the remainder of these Terms will remain in effect.

Right to Opt Out of Arbitration

You may opt out of this arbitration agreement by sending written notice to [email protected] within 30 days of first agreeing to these Terms. Your notice must include your name, mailing address, and a clear statement that you wish to opt out of arbitration. If you opt out, neither you nor we will be bound by the arbitration provisions, but the remainder of these Terms will continue to apply.

Court Proceedings if Arbitration Does Not Apply

If the arbitration agreement does not apply to a particular Dispute, or if you opt out, the Dispute will be resolved exclusively in the state or federal courts located in the jurisdiction where A&H Enterprise Capital Investments LLC is primarily based, and you consent to the personal jurisdiction and venue of those courts.

Nothing in this section limits any rights you may have under applicable consumer protection laws that cannot be waived by agreement.


Changes to These Terms

Severability
